i
Elk River
Municipal Utilities
322 King Avenue phone: 763.441.2020
Elk River,MN 55330 Fax:763.441.8099
June 5, 2003
To: Elk River Municipal Utilities Commission
John Dietz
Jerry Takle
James Tralle
From: Bryan C. Adams
Subject: Customer List Policy
We often get calls from marketing people asking for our customer list. Previously, this
information was public information and we were required to provide our customer list. I
believe in 2001, the Government data practice section of Minnesota Statutes was revised
to reflect the electric utility customer lists are private data and no longer public
information.
As a housekeeping matter, we need to revise our Customer List Policy in our policy
manual as follows.
Current Policy:
Customer lists are public information and the Utility is obligated to comply with
requests for the lists. The charge for the list will be $20.00.
Revise to the following:
Municipal electric utility data are classified as private or nonpublic information
under Minn. Stat. §13.685. Other municipal utility data are classified as public
pursuant to the general presumption in Minn. Stat. §13.03, subd. 1. The Depart-
ment of Administration (DOA) advised that if the city is supplying electric
services (with or without the addition of other utility services) to a particular
customer, the name and address of that customer are private data. However, if the
city is supplying only water and sewer services to a particular customer, the name
and address of that customer are public data.
