Elk REQUEST FOR ACTION <br /> River <br /> TO ITEM NUMBER <br /> Mayor and City Council 10.1 <br /> AGENDA SECTION MEETING DATE PREPARED BY <br /> Work Session June 17, 2013 Jeremy Barnhart,Deputy Director, <br /> CODD <br /> ITEM DESCRIPTION REVIEWED By <br /> Starbucks Concept Review Cal Portner, City Administrator <br /> REVIEWED BY <br /> ACTION REQUESTED <br /> Provide informal, nonbinding feedback on the proposed Planned Unit Development (PUD) Agreement <br /> amendment that would allow a drive through lane on the property line. <br /> BACKGROUND/DISCUSSION <br /> Starbucks is proposing to occupy a portion of the building at 19179 Freeport Street. LeAnn Chin's <br /> occupies the western portion of the building. To facilitate Starbucks, a drive through lane will need to be <br /> added. Due to limited space,the drive through lane is proposed to be located on the east side of the <br /> building,immediately adjacent to the Highway 169 right-of-way (ROW). <br /> The property is zoned PUD, and is governed by the Elk Park Center PUD Agreement. The Council has <br /> the discretion to establish setbacks and other standards as they deem appropriate for the area. <br /> Typically, a setback of 10 feet is required between paved areas and the adjacent property line. This is for <br /> a number of reasons,including visual separation between parking and streets, opportunities for <br /> landscaping, and snow storage. <br /> The developer proposes a setback of less than a foot on the east property line, the line shared by <br /> MnDOT. MnDOT will not permit water to drain onto the ROW, or any encroachment over the line. <br /> This can be accommodated through site design. The Council should provide feedback regarding their <br /> opinions of the proposed drive through. The issues of visual separation,landscaping, and snow storage <br /> are not applicable here as the wide Hwy 169 ROW provides necessary visual separation, and site design <br /> can accommodate snow storage. <br /> A representative of the applicant will be at the meeting. <br /> ATTACHMENTS <br /> ■ Concept plan <br /> P O W E R E D BY <br /> NaA f RE] <br />
