Box 490 <br />Elk River, MN 55330-0490 <br /> <br />RE: <br /> <br />BOSTON STREET IMPROVEMENTS <br />PUBLIC HEARING <br /> <br />Dear Council Members: <br /> <br />As you are aware, the public hearing for the Boston Street improvement is scheduled for the <br />evening of Monday, April 6, 1998. Please bring the green covered Feasibility Study dated <br />January 1998 with an amendment date of March 1998. If you need a new copy of the <br />Feasibility Study, please let City Hall know and we will make them available. <br /> <br />As you recall, this feasibility consists of extending sanitary sewer and water along Boston <br />Street north of Orono Road to three residential properties and Orono cemetery. The project <br />was petitioned for by the residential properties along Boston Street. <br /> <br />With regard to financing of the improvement, the feasibility recommends that two of the <br />residential properties can be further sub-divided, and that they be treated as two units with <br />regard to utility and street restoration assessments. The feasibility goes on further to <br />recommend that the sanitary sewer and water assessment for the potential second lot be <br />deferred until such time that the lot is split, but that the street restoration assessment be levied <br />at this time. This results in $12,300 of assessments being deferred. The other important point <br />to make is that Minnesota State Statute 306.14 Taxes; Road; Special Assessment, deals with <br />assessments against cemeteries. It appears from this state statute that if Orono cemetery <br />objects to their assessment of $5,325 for water improvements, the City may be unable to <br />assess them. This is a question that would need to be further investigated by the City <br />Attorney. <br /> <br />At the close of the public hearing, if the City Council desires to proceed with the project a <br />resolution is attached for your consideration.
