.y of <br /> <br />Item 6.3. <br /> <br />Memorandum <br /> <br />River <br /> <br />TO: <br /> <br />FROM: <br /> <br />MAYOR AND CITY COUNCIL <br /> <br />STEPHEN ROHLF, BUILDING AND <br />ZONING ADMINISTRATOR <br /> <br />DATE: <br /> <br />MARCH 2, 1998 <br /> <br />SUBJECT: <br /> <br />WETLAND CONSERVATION <br />ACT DECISION (WINDSOR <br />WOODS) <br /> <br />Marly Glines of Dynamics Design & Land Co. has made application to fill 6,900 sq. ft. of <br />Type 2 wetland to accommodate the plat of Windsor Woods. The wetland area proposed <br />to be filled is located in the Northwest Quarter of the Northeast Quarter, Section 17, <br />Township 33, Range 26, Sherburne County, Minnesota (see attached map). <br /> <br />FINDINGS <br /> <br />1. The original delineation was completed by Mary West on 12/5/97 and the <br /> replacement plan was provided by John Oliver & Associates on 12/23/97. <br /> <br />The Technical Evaluation Panel reviewed the proposal on January 6, 1998. It was the <br />finding of the technical panel that the area proposed to be filled was unavoidable due <br />to lack of access to the property. The area impacted by the road access was reduce, <br />however, by increasing the adjacent side slopes and making the low point of the <br />proposed road be centered in the wetland. <br /> <br />On January 8, 1998 the city sent out combined notification of the proposed filling and <br />replacement plan to the appropriate parties and did not receive any negative <br />comments on the proposal. <br /> <br />RECOMMENDATION <br />Staff recommends approval of both the proposed filling and mitigation plan for this <br />project with the following stipulations: <br /> <br />1. That only the run-off from the proposed road and not overflow from the <br /> adjacent wetland be filtered through the proposed sedimentation ponds. <br />2. That the cost of the proposed mitigation plan be covered by a letter of credit in <br /> favor of the city for a period of one year after completion. <br />3. That a restrictive covenant be recorded on the mitigation areas. <br />4. That Sherburne County approves the plat's drainage plan. <br />5. That the developer submits a report on the wetlands to the city one year after <br /> their construction. <br /> <br />13065 Orono Parkway · P.O.
