¥ of <br /> <br />iver <br /> <br />MEMORANDUM <br /> <br />Item #4.1. <br /> <br />TO: <br /> <br />FROM: <br /> <br />DATE: <br /> <br />SUBJECT: <br /> <br />Mayor & City Council <br /> <br />Jay Carlson, Housing Inspector <br />February 2, 1998 ~C <br />Ordinance Amendment to Housing <br />Maintenance Code, Section 1007.14- <br />Update on Housing Inspections <br /> <br />The current wording in Section 1007.14 of the Housing Code may cause the <br />city to require building owners to add foyers and communication systems to <br />buildings that were constructed prior to the adoption of the Housing Code. <br />Therefore, we would like to change the wording of that section by separating <br />out the requirement for a fire department key box, and by adding an <br />exception eliminating the locked building entry door and communication <br />system requirements for existing buildings. <br /> <br />The following are rationales for amending Section 1007.14 of the City of Elk <br />River Housing Ordinance. <br /> <br />The Housing Ordinance must comply with the State Building Code. <br />Under The State Building Code this department generally cannot require <br />an existing building to meet current standards without there having been <br />a change of occupancy or use. Section 1007.14 of the ordinance, as <br />written, would require that the existing buildings be brought to a <br />standard not in place at the time of its construction placing an undue <br />burden onto the owners of the property. <br /> <br />o <br /> <br />This matter could be corrected by separating from paragraph 2, the <br />requirement for a lock box containing certain keys, and by allowing an <br />exception to the requirement for locked foyer doors, and a communication <br />system for buildings butt before the adoption of the Housing Ordinance. <br /> <br />I will be available Monday evening to answer any questions you may have <br />regarding this issue.
