RESOLUTION I I - 68 <br />• A RESOLUTION FOR THE CITY OF ELK RIVER <br />A RESOLUTION ADOPTING AND LEVYING ASSESSMENTS <br />FOR UNPAID SEWER SERVICES <br />AS OF SEPTEMBER 30, 201 1 <br />WHEREAS, Minnesota Statutes Sections 116A.22 and 444.075 authorize the city to <br />annually levy an assessment equal to such unpaid cost as of September 30 of <br />each year fox sewer services; and, <br />WHEREAS, the city's ordinance Section 78-191 authorizes the city to levy an assessment <br />against property for sewer services equal to the unpaid charges as of <br />September 30; and, <br />WHEREAS, all customers and property owners with delinquent balances as of September <br />30, 2011, have been given adequate notice of this pending assessment and <br />have been given opportunities to pay prior to this assessment being levied; <br />and, <br />WHEREAS, State law does not require a public hearing or notice before levying such <br />• assessments. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River that <br />the parcels and amounts listed on Exl~libit A attached hereto, are correct and made a part hereof, axe <br />to be levied and axe to be certified to the Sherburne County Auditor. <br />Passed and adopted by the City Council of the City of Elk River this 21St day of November, 2011. <br />~. <br />J. ietz, M or <br />ATTEST: <br />~°' <br />/~ <br />Tina Allard, City Clerk <br />• <br />C:\Users\jmiller\AppData\Local\Microsoft\Windows\Temponuy Internet Files\Low\ContentIES\ROFWF932\2011%20Council%20Memo%20- <br />20garbage%20and%20sewer[1].docx <br />
