This policy established a <br />rental rate for a third party to attache communication equipment to ERMU poles. Although <br />ERMU as public power is exempt from the Federal Communications Act of 1978 and its re- <br />enactment and extension in 1996, it is one of the reasons why pole attachments are allowed. <br />This current policy is attached for reference. <br />DISCUSSION: <br />In the past, ERMU has had written agreements with the third parties which outline some of the <br />specifics. The Utilities is currently working with a communication company that desires to <br />attach their communication equipment to ERMU poles. An updated Pole Attachment Agreement <br />has been drafted with the assistance of ERMU legal counsel. This agreement is attached for <br />reference. Through this process of drafting an updated attachment agreement, it has been noted <br />that the Pole Attachment Policy needed to be updated as well. This proposed Pole Attachment <br />Policy is attached for Commission review and consideration. <br />ACTION REQUESTED: <br />Staff recommends that adoption of the revised Pole Attachment Policy. <br />
