Peter Beck, Ci Attorne Public Hearing on revocation of Conditional Use Permit REVIEWED BY ACTION REQUESTED Open public hearing At the April 18, 2011 City Council meeting, the City Council directed staff to begin revocation proceedings for the Wapiti Park Campground conditional use permit. The owner and the operator of Wapiti Park Campground have been notified of the hearing. The next steps in the process are for the Council to hold a public hearing to receive testimony and evidence, to establish findings, and to determine whether the conditional use permit for Wapiti Park Campground shall be revoked for failure to comply with the conditions set forth in the approval of the conditional use permit. If the Council determines not to revoke the conditional use permit No further action would be required. If the Council determines to revoke the conditional use permit for Wapiti Park Campground Staff recommends that Council direct staff to prepare a resolution with proposed findings of fact regarding revocation of the conditional use permit fox City Council consideration at its meeting on June 27, 2011 or such future date as the Council directs. Council should provide input to staff regarding the findings of fact that should be included in the resolution. BACKGROUND/DISCUSSION Section 30-659 of the City Code governs the process for revocation of a conditional use permit. A copy of Section 30-659 is attached for reference. A chronological history of Planning Commission and City Council meetings and actions regarding Wapiti Park Campground is attached, as are the staff reports and minutes of all meetings. In summary: A conditional use permit was approved for Wapiti Park Campground in May 1984, subject to seven conditions. The conditions included a condition that wheels remain on vehicles parked in the campground and a condition that the provisions of Minnesota Statutes, Section 327.10 through 327.28, pertaining to recreational camping areas and recreational camping vehicles, shall apply and be conditions within the City's conditional use permit.
