Information <br />MEMORANDUM <br />TO: Parks and Recreation Commission <br />FROM: Michele McPherson, Director of Planning <br />DATE: February 3, 2005 <br />SUBJECT: City Attorney's Comments Regarding Transfer of Development <br />Rights Program <br />Staff requested that the City Attorney, Peter Beck, review the Transfer of Development <br />Rights Program drafted by Commissioner Niziolek. Mr. Beck's comments are as follows: <br />1. How will the increase of density from one zone to the other be sold politically to the <br />Council? In some cases, the density could potentially double from what is currently <br />allowed under the Zoning Ordinance. <br />2. There is a potential administrative burden that needs to be considered and calculated <br />into this program. Administrative responsibilities would include crafting the ordinance <br />language, maintaining the marketing site, and tracking the sale of development coupons. <br />In Mr. Beck's opinion, this is an unusual program for a city to undertake.
