MEETING OF THE ELK RIVER PLANNING COMMISSION <br />• HELD AT ELK RIVER CITY HALL <br />TUESDAY, APRIL 13, 2010 <br />Members Present: Chair Westberg, Commissioners Anderson, Bell, Ives, Johnson, Lemke and <br />Scott <br />Members Absent: None <br />Staff Present: JeremyBarnhart, Planning Manger; Chris Leeseberg, Planner/Park Planner; <br />Rebecca Haug, Environmental Admuristrator; Debbie Huebner, Recording <br />Secretary <br />Also Present: Peter Beck, City Attorney <br />Call Meeting To Order <br />Pursuant to due call and notice thereof, the meeting of the Elk River Planning Commission <br />was called to order at 6:30 p.m by Chair Scott. <br />2. Consider 4/ 13/ 10 Planning Commission Agenda <br />MOVED BY COMMISSIONER SCOTT AND SECONDED BY <br />COMMISSIONER LEMKE TO APPROVE THE APRIL 13, 2010 PLANNING <br />• COMMISSION AGENDA. MOTION CARRIED 7-0. <br />3. Consider 2/9/ 10 Planning Commission Minutes <br />MOVED BY COMMISSIONER IVES AND SECONDED BY COMMISSIONER <br />ANDERSON TO APPROVE THE FEBRUARY 9, 2010 MINUTES. MOTION <br />CARRIED 7-0. <br />4. Planning Commission Representative to Attend City Council Meeting <br />Commissioner Anderson will attend the April 19, 2010 City Council meeting. <br />5.1. <br />Ms. Haug introduced City Attorney Peter Beck Mr. Beck provided a summary of cites <br />decision to zone the entire Elk River Landfill property into the Mineral Excavation Overlay <br />District and Solid Waste Facility Overlay District. He noted that there were issues with legal <br />descriptions and the citys engineer has come up with a legal description to include all of <br />their property. <br />Commissioner Ives asked if the Landfill has been operating with the assumption that their <br />property was zoned properly. Mr. Beck stated that it is the Landfill's position that they have <br />been depositing in an area outside of the SWF District. He stated this request is a "clean <br />up" effort to ensure that all of the Landfill property is in the appropriate district. <br />
