Box 490 <br />Elk River, MN 55330 <br /> <br />RE: DOWNTOWN PARKING LOT REPAIRS <br /> <br />Dear Mr. Klaers: <br /> <br />This correspondence is intended to restate the status of the repairs on the downtown <br />parking lot. As you recall, this project was done by a change order to the contract of <br />Barbarossa & Sons for the Western Area Phase II improvements. That project is currently <br />complete with the only outstanding issue being the downtown parking lot. We have met <br />with Barbarossa & Sons and their subcontractor, Bauerly Brothers, Inc., last fall. The <br />result of that meeting was the withholding of half of the payment for the bituminous <br />pavement on the parking lot and a 1% withholding on the entire contract. As you recall, <br />that contract was in excess of $2,000,000. Therefore, we have sufficient funds to repair <br />the parking lot surface. We also left it that the repairs would be undertaken by the City <br />and would include seal coating and possibly removal and replacement of specific areas. <br />After the City has satisfactorily repaired the bituminous surface, we would provide <br />Barbarossa & Sons with a full accounting of the money spent by the City and release the <br />remaining payment for the bituminous surfacing and any retainage that is left. <br /> <br />There are two schools of thought as to how and when the City can undertake this. One <br />would be to undertake it as soon as weather permits in the spring to remedy the appearance <br />problems of the parking lot. However, the method that I would recommend would be to <br />wait until later in the summer or early fall. This would allow the landscaping in the <br />parking lot to be completed and any bituminous that is marred by the landscaping <br />operations could then be repaired with the seal coat. Also, by waiting until later in the <br />summer, this would give us a little more time to see if there are any areas that need <br />structural repair. None appeared to need structural repair last fall, but waiting a little <br />longer in 1996 before the final repairs are made would be, in my opinion, a good idea. <br /> <br />An Equal Opportunity Employer <br /> <br /> <br />
