of ver City of Elk River City Council Resolution 25-49 A Resolution of the City Council of the City of Elk River Approving the Acquisition of Real Property WHEREAS, Coborn's Incorporated ("Seller") is the fee owner of the real property located in the City of Elk River, County of Sherburne, State of Minnesota, which is legally described as Lot 1, Block 2, Hillside Crossing, according to the recorded plat thereof, Sherburne County, Minnesota (PID 75-00566-0210) ("Property"); WHEREAS, the Seller proposes to convey the Property to the City for a purchase price of $1.00 and pursuant to the terms of the Purchase Agreement presented to the City Council ("Purchase Agreement"); WHEREAS, the City Council desires to acquire the Property and has received and reviewed the Purchase Agreement to be entered into by and between the City and Seller; WHEREAS, acquiring ownership of the Property by the City would serve the public interest; WHEREAS, Minnesota Statutes 5 462.356, subd. 2, requires that the Planning Commission review the City's proposed acquisition of the Property for compliance with the City's comprehensive municipal plan and to report to the City Council in writing its findings; WHEREAS, Minnesota Statutes 5 462.356, subd. 2, provides an exception from the requirement for review by the Planning Commission upon 2/3 vote of the City Council dispensing with the requirement and finding that the acquisition of the Property has no relationship to the City's comprehensive municipal plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota, as follows: 1. The City Council finds that the acquisition of the Property under the Purchase Agreement has no relationship to the City's comprehensive municipal plan. 2. Review by the Planning Commission of the acquisition of the Property is hereby dispensed with. 3. The Purchase Agreement is hereby approved in substantially the same form as presented. I
