of <br />ver City of Elk River <br />City Council <br />Resolution 25-49 <br />A Resolution of the City Council of the City of Elk River Approving the <br />Acquisition of Real Property <br />WHEREAS, Coborn's Incorporated ("Seller") is the fee owner of the real property located <br />in the City of Elk River, County of Sherburne, State of Minnesota, which is legally described <br />as Lot 1, Block 2, Hillside Crossing, according to the recorded plat thereof, Sherburne <br />County, Minnesota (PID 75-00566-0210) ("Property"); <br />WHEREAS, the Seller proposes to convey the Property to the City for a purchase price of <br />$1.00 and pursuant to the terms of the Purchase Agreement presented to the City Council <br />("Purchase Agreement"); <br />WHEREAS, the City Council desires to acquire the Property and has received and <br />reviewed the Purchase Agreement to be entered into by and between the City and Seller; <br />WHEREAS, acquiring ownership of the Property by the City would serve the public <br />interest; <br />WHEREAS, Minnesota Statutes 5 462.356, subd. 2, requires that the Planning <br />Commission review the City's proposed acquisition of the Property for compliance with the <br />City's comprehensive municipal plan and to report to the City Council in writing its findings; <br />WHEREAS, Minnesota Statutes 5 462.356, subd. 2, provides an exception from the <br />requirement for review by the Planning Commission upon 2/3 vote of the City Council <br />dispensing with the requirement and finding that the acquisition of the Property has no <br />relationship to the City's comprehensive municipal plan. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk <br />River, Minnesota, as follows: <br />1. The City Council finds that the acquisition of the Property under the Purchase <br />Agreement has no relationship to the City's comprehensive municipal plan. <br />2. Review by the Planning Commission of the acquisition of the Property is hereby <br />dispensed with. <br />3. The Purchase Agreement is hereby approved in substantially the same form as <br />presented. <br />I <br />
