ARTICLE III. SOLID WASTE FACILITIES* . Page 9 of 23 <br />(Code 1982, § 604.12) <br />Sec. 5$-128. Perm. <br />Unless otherwise provided by the city council, each license granted pursuant to the provisions of this division <br />shall expire two years from the date of issuance, unless sooner revoked. <br />(Code 1982, § 604.14(1)) <br />Sec. 58-929. Renewat. <br />(a) Application for renewal of a license granted under this division shall be made in writing to the city council <br />at least 90 days prior to the expiration of the license. The application for renewal shall include: <br />(1) A statement of any changes in the information submitted in the last approved license application. <br />(2) A statement as to the amount of solid waste disposed of, stored, processed, or burned during the <br />24-month period prior to the filing of the application. <br />(3) A statement of the expected volume of solid waste to be disposed, of processed, stored, or burned <br />in the next 24-month period. <br />(b) Renewal of a solid waste facility license shall be denied if; <br />(1) A renewal application is not submitted, or is submitted without the information required; <br />(2) There is a current violation of the existing license or of any provision of this article, this Code, or <br />any state or federal law, regulation, or standard with respect to the facility or the operation of the facility; <br />or <br />(3) There have been repeated prior violations of the terms of the existing license or of any provision of <br />this article, this Code, or any state or federal law, regulation, or standard with respect to the facility ar <br />the operation of the facility. <br />(c) If the volume of solid waste disposed of, stored, processed, or burned at the facility, at the time of renewal, <br />exceeds the volume originally proposed for the facility, or is expected within the proposed two-year renewal <br />period to do so, the city council may condition renewal of the license on restricting annual volumes to those <br />approved in the original license, if it determines that it is necessary to do so for the facility to continue to meet <br />the standards required under this article for issuance of a license. <br />(Code 1982, § 604.14(2), (3)) <br />Sec. 58-130. Suspension ar revocation. <br />(a) Grounds. Solid waste facility licenses issued under this article may be revoked by the city council, and <br />operation of the licensed facility ordered terminated, if: <br />(1) There is a current and ongoing violation of the license or of any provision of this article, this Code, <br />or any state or federal law, regulation, or standard with respect to the facility or the operation of the <br />facility; or <br />(2) There have been repeated prior violations of the license or of any provision of this article, this <br />Code, or any state or federal law, regulation, or standard with respect to the fiacifity or the operation of <br />the facility. <br />(b) Suspension.
