Given <br />City's then-existing CUP and );icense approval of ERL's 92.1-acre MSW lazdfill area, -City <br />understood (and reiterated Ibis understanding at the l7ecezxzbex 17 hearing) that the only area to <br />"expand ... on tkze Landfill property" was to the south into the 200-foot buffer area. More <br />specifically, the landfill expaxzsioxa area within this 200-foot bu~fex area, while main~Caining the <br />200-foot buffer on t17;e east and 'west, is the 7.5 acres which is south of the approved disposal <br />area. A.xzd, because the expansion to the southern, edge of the existing 137.4-acre laxzdfzll <br />property would (due to the southward xuoverrze~,t of the end slope on the south side of the <br />landfill) allow additional MS W to be disposed of on 5.9 acres of the already permitted disposal <br />area, the total expansion area is actually 13.4 acres. See Diagram (attached); Ex. 46. <br />.A,s part of ERL and Tiller's October 2002 request to mine within most of the 7.5-acre <br />arts, City staff xepresezzted that it would be "inappropriate [fox City] to consider" this expa~sioxz <br />request, which it described as a ''component" of the expansion of the 1and~ll, without the full <br />landfill expansion onto the 108.8-acre SDA, property.
