Staff is recommending that paragraph 3 be amended through the italicized changes, to read: "A <br />Buffer Zone shall be established within the perimeter of the Landfill Property around the waste <br />disposal areas of not less than 200 feet, except on the noxth side. Witlvn this Buffer Zone, no waste <br />disposal may occur. The Landfill shall develop an inventory of significant trees within the buffer <br />zone. The preservation of trees within the buffer zone shall be provided for during the construction, <br />operation, and be included in the end use plan to be .submitted for approval by December 3 ~, 207 ~ by the city." <br />At the Planning Commission meeting on Tuesday, February 9, 2010 the Applicant was in agreement <br />with this change in the language. <br />3. Paragraph 4 (29) Cell 17. The applicant has recently submitted the "Cell 17 Perimeter Berm Base <br />Grades" Plan (dated Febfuaiy 2010) which provides additional engineering design detail for the final <br />landfill cell. The newly submitted plan demonstrates site development to match the approved 2001 <br />Final Contour Plan for the Site. Staff is recommending a revision to paragraph 4 (29) which would <br />require Applicant to Submit additional information to clarify Cell 17 perimeter berm (or south side <br />slope) const~.•uction. <br />4. Paragraph 4 (30) Alternative Cover. Staff agrees with the Applicant's request to allow alternate <br />cover and recommends adoption of paragraph 4 (30) as proposed. <br />5. Paragraph 4 (31) End Use Plan. At the Planning Commission meeting on Tuesday, February 9, <br />2010, the Applicant agreed to provide the City with an End Use Plan by December 31, 2011 since <br />the City Council has not approved an End Use Plan for the site. <br />6. Paragraph 14 Permit Period. At the Planning Commission meeting Tuesday, February 9, 201.0, <br />Staff recommended changing the language pertaining to the permit period for the CUP. Staff and <br />the Applicant have agreed to omit the language stating "until February _, 2012." <br />Solid Waste Facility License (SWFL) <br />The Applicant's SWFL does not include a section on buffer zone/screening, but does include sections on <br />Cell 17, Alternative Cover, and End Use Plan. Staff recommends the same revisions made on those items <br />in the CUP be made in the SWFL. <br />In addition, the SWFL includes a section (Section 1 (9)) on Dust, Noise, and Odor. Staff and the <br />Applicant have agreed to add language to that section related to odor to include: "The Permitee agrees <br />that it will use best management practices to control against odors. The Environmental Administrator <br />lnay make recommendations regarding possible odor controls. If a verified odor problem is ongoing, <br />both parties agree to institute good faith negotiations to minimise the odor problem. If in the event that <br />the City receives ten or more complaints within asix-hour period relating to a single odor description and <br />this odor complaint has been verified by both City and Permitee and identified as coming from the <br />Facility, the Permitee shall cease such activity(s) that are the direct cause of the odor(s). Normal <br />activity(s) shall not resume until the Perinitee has, to the satisfaction of the City, fully mitigated against <br />such odor(s)." <br />All of the changes recommended in tlv.s staff report are included in the attached CUP and License. <br />S:\Council\Rebecca\ERL CU 10-02-CUP 216 10.doc <br />
