2009) outlining design modifications to the expansion proposal, the end use plan for the landfill, and other issues; and ~XIHEREAS, Citj= Staff and CitS= consultants review=ed the revised plans, the Voith Report, the September 8, 2009 letter and all other materials submitted by ERL, and prepared a staff report which was delivered to the Cit-1= Council and Planning Commission, along with all of the materials submitted by ERL, on September 8, 2009; and WHEREAS, the City Council and Planning Commission met in joint workshop session on September 14, 2009 to discuss the materials submitted by ERL, including the revisions to the expansion proposal for the Landfill; and WHEREAS, ERL was pro~rided an opportunity to present its revised plans and proposed design modifications for the expansion to the City= Council and the Planting Commission at the September 14, 2009 workshop session and the Citj=Council had the opportunitl= to discuss and ask questions regarding the rejnsed-proposal; and _ WHEREAS, on September 21, 2009 the. Elk River City Council held a public hearing on the Application and provided ERL, WMI and Tiller, as well as all members of the public desv:ing to do so, the opportunity to present additional testimony and comment on the Application, as revised, and to submit additional written evidence; and WHEREAS, after all parties desiring to present testimony and offer evidence for or against the Application had had the opportunity to do so, the Ells River City Council closed the public hearing on the Application, continued its discussion of the Application, and reached the decision incorporated in this resolution; and WHEREAS, ERL has agreed in writing to an e~;tension of the City's time deadline for acting on d1e application under Minnesota Statutes, Section 15.99 to September 26, 2009.
