supporting equipment shall be enclosed by an eight-foot-high chain link fence with a <br />locked gate. 30-1837 a-(6). <br />8. Metal towers shall be constructed of, or treated with, corrosive resistant material. 30- <br />1837 e-(7). <br />9. Only one tower shall exist at any one time on any lot or parcel. The minimum lot size <br />requirement shall be one acre. 30-1837 a-(8). <br />10. Towers and antennas shall be designed to blend into the surrounding environment <br />through the use of building materials, color, textures, camouflaging architectural <br />treatment, screening and landscaping, except in instances where the color is dictated <br />by federal or state authorities such as the Federal Aviation Administration. 30-1837 f- <br />(1). <br />11. No advertising, logos or identification of any kind is permitted, except as may be <br />required by federal and state authorities. 30-1837 g. <br />Summary <br />Sprint is requesting permission to construct a 150' tall telecommunications tower on a portion of the <br />property owned by the St Louis Park Sportsman's Club, in Elk River. City ordinance requires <br />telecommunication towers only be located in AT overlay zones. <br />To change the zoning to include AT zone, the ordinance includes additional criteria. These criteria <br />include: <br />30-1837 (b) Findings. In order to accommodate the communication needs of residents and businesses while <br />protecting the public health, safety, and general welfare, the city council finds these regulations necessary in <br />order to: <br />(7) Establish standards whichpermit a reasonable and equitable opportunity for the establishment of <br />wireless telecommunication service in the city. <br />(2) Avoid potential damage to adjacent properties from tower failure through structural standards and <br />setback requirements. <br />(3) Minimise adverse visual ~ects of towers through careful design and siting standards which attempt to <br />screen and/ or camouflage towers and antennas from adjacent private and public properly. <br />(4) Maximise the use of existing and approved towers, buildings and other structures to accommodate new <br />winless telecommunication antennas in order to reduce the number of towers needed to serve the community. <br />It appears that the criteria are satisfied, due to the tower's location, its height, and its design. <br />In addition to the rezoning, a conditional use permit is required. With the conditions as proposed, Staff <br />feels as though the criteria necessary to grant a CUP are satisfied. <br />Planning Commission Discussion <br />The Planning Commission questioned whether the entire sportsman club property will be rezoned. Only <br />the lease area will be rezoned. <br />Public Comment <br />No public comment was received. After the meeting, the applicant asked that the attached email be <br />forwarded to the Council. The Applicant would request that conditions #3 and #12 be removed. <br />Condition #3 requires a fall zone analysis be completed that states that should the tower fall, it would fall <br />in a specific location, and within a lesser distance than the setback.
