City Council Nfinutes Page 4 <br />September 10, 2001 <br /> <br /> The City Administrator questioned who would be responsible for the repair and <br /> maintenance of the small theater. Dr. Jenson indicated that the school would commit to <br /> maintenance, utilities, and custodial service costs for the small theater. <br /> <br />Councilmember Kuester discussed the issue of the need for the small theater versus the <br />large theater by both the community and the students. She indicated that the small theater <br />would not completely meet the needs of the arts community. She further stated that she did <br />not like the concept of the small theater being a "city theater" as it should be available for <br />students during the day and the large theater should be available for the community groups <br />during the evenings or when it is not in use by the students. Principal Voight indicated that <br />he envisions this type of a partnership between the school and the city. He noted that the <br />City participating in the small theater guarantees access to other facilities. <br /> <br />Mayor Klinzing indicated that she sees this as an opportunity for the City to make an <br />investment in the community. <br /> <br />Councilmember Motin indicated that he would like to be assured that the theater would <br />provide a benefit to the City. He stated he is in favor of partnering with the school district in <br />this endeavor because both the students and the community will use the theater. <br /> <br />Councilmember Dietz suggested that the Superintendent come back to the Council with <br />funding options and agreement details. The City Administrator indicated that these issues <br />could be discussed at the next Council meeting. <br /> <br />4.5. Approval of Special Legislation for On-Sale Liquor Licenses <br /> <br />The City Clerk informed the Council that special legislation under Senate File #1752 was <br />recendy adopted that increases the city's number of on-sale liquor licenses from 12 to 18. <br /> <br />COUNCILMEMBER DIETZ MOVED TO ADOPT RESOLUTION 01-63 <br />APPROVING SENATE FILE 1752; LEGISLATION ALLOWING THE CITY OF <br />ELK RIVER TO ISSUE SIX ADDITIONAL ON-SALE LIQUOR LICENSES. <br />COUNCILMEMBER TVEITE SECONDED THE MOTION. THE MOTION <br />CARRIED 5-0. <br /> <br />4.6. Consider Scott Powell Request Regarding Funding for 171,t Avenue Traffic Signal <br /> <br />Terry Maurer discussed the issue of the 171,t Avenue traffic signal including the city's and <br />MnDOT's cost in relation to Scott Powell's cost for the signal. Terry discussed the city's <br />past policy of paying for signals. He indicated that these issues have been reviewed on a <br />cases-by-case basis. <br /> <br />Councilmember Dietz indicated that it has always been past practice to charge the developer <br />for signal lights. He stated that it would be fab to other developers to not charge Mr. Powell <br />for the signal light as it is Mr. Powell who is requiring the signal. <br /> <br />Mayor IC!inzing indicated that the issue to consider is whether the other properties served by <br />the signal should participate in the cost. <br /> <br />Councilmember Motin noted that this is a situation where Saxon and Napa get some <br />ancillary benefit from the traffic light as it makes the intersection safer, but if the <br />development were not going in, the City would not be closing down their entrance onto the <br /> <br /> <br />
