2009) outlining design modifications to the expansion proposal, the end use plan for the landfill, and other issues; and ~XIHEREAS, CitST Staff and CitsT consultants reviewed the revised plans, die Void1 Report, the September 8, 20091etter and all other materials submitted by ERL, and prepared a staff report which was delivered to d1e City Council and Planning Commission, along wide all of d1e materials submitted by ERL, on September 8, 2009; and WHEREAS, the City Council and Planning Commission met in joint workshop session on September 14, 2009 to discuss the materials submitted by ERL, including the revisions to the expansion proposal for dze Landfill; and WHEREAS, ERL was pro~rided an opportunity to present its revised plans and proposed design modifications for the expansion to the Cite Council and d7e Plamiing Commission at dze September 14, 2009 workshop session and the City Council had the opportunity to discuss and ask questions regarding the reprised proposal; and WHEREAS, on September 21, 2009 die Elk River City Council held a public hearing on die Application and provided ERL, WA2I and Tiller, as well as all members of the public desiring to do so, d1e opportunity to present additional testimony and comment on die Application, as retrised, and to subunit additional written evidence; and WHEREAS, after all parties desiring to present testimony and offer evidence for or against d1e Application had had d1e opportunity to do so, the Ells River City Council closed the public hearing on the Application, contuiued its discussion of d1e Application, and reached d1e decision incorporated in dlis resolution; and WHEREAS, ERL has agreed in writing to an extension of the City's time deadline for acting on dle application under Minnesota Statutes, Section 15.99 to September 26, 2009.
