The <br />required setback from the unnamed tributary is 50 feet from the ordinary <br />high water mark. The required front yard setback is 30 feet from the front <br />property line. The variance request is the end result of confusion between <br />the developer/city/county/DNR concerning the jurisdiction of a small <br />stream/ditch which bisects the Meadowvale Heights Second Addition.
