Box 490 <br />Elk River, Minnesota 55330-0490 <br /> <br />RE: 2001 OVERLAY IMPROVEMENT <br /> <br />Dear Council Members: <br /> <br />As you are aware, the public hearing/assessment hearing for the 2001 Oveday Improvement <br />project is scheduled for Monday, August 13, 2001. I will have a prepared presentation <br />regarding the proposed improvements and assessments of the project. At the close of my <br />presentation, I will be available to answer questions from the City Council and/or affected <br />property owners. <br /> <br />As directed previously by the City Council, bids were opened for the 2001 Overlay Improvement <br />on Tuesday, August 7, 2001. The Iow bidder was Bauedy Companies Inc. at $293,926.88 (This <br />total bid includes the paving of 221st Avenue which will be funded by the developers of Ridges <br />of Rice Lake.). Bauerly Company's total bid is significantly below the construction cost <br />estimated in the project feasibility study. Therefore, staff is recommending a reduction in the <br />proposed assessments from $1,550.00 per assessable unit to $1,375.00 per assessable unit. <br />As a point of reference, the 1998 Oveday Improvement was assessed at $1,450.00 per <br />assessable unit. <br /> <br />As the City Council is aware, assessed property owners have the dght to appeal the <br />assessment of this project again their property. In order to preserve their rights to appeal, the <br />property owner must submit a written objection to the Mayor or City Administrator at or before <br />the assessment headng. SimlMv orally stating an objection to the assessment at the <br />assessment hearing does not preserve the property owner's right to appeal the <br />assessment. As of the date of this memo, staff has received no wdtten objections to the <br />proposed assessment. <br /> <br />There are three areas the staff would like the City Council to consider potential modifications to <br />the assessment roll. They are as follows: <br /> 1. The area on 197th Avenue from Trunk Highway (TH) 169 to Evans Street was <br /> inadvertently included in the assessment. This portion of the street was newly <br /> constructed with the Hillside Crossing development. Therefore, we would <br /> recommend that three parcels be removed from the assessment roll.
