That Sec'tian. <br />30 -658 of the Elk River City <br />Code shall be amended to read <br />as follows: <br />Sec. 30 -658. ,Interim uses. <br />a) Definiti#s. The defini- <br />tions in section 30 -1 are appli- <br />cable in this section. <br />b) Authorization. The City <br />Council may uthorize interim <br />uses of prope ty by issuance of <br />interim use rmits. <br />c) Required endings. Before <br />the City Co ncil may autho- <br />rize an interim use, it must <br />make the foll wing findings: <br />1. The period of time for which <br />the interim a permit is to be <br />granted will erminate before <br />any adverse impacts are felt <br />upon adjacen properties. <br />2. There is adequate as fur - <br />ance that th property will be <br />left in suita a condition after <br />the use is to ated. <br />3. The use 's similar to uses <br />..,allowed in the zoning district in <br />rich the property is located. <br />The date or event that will <br />terminate th use can be iden- <br />tified with ce ainty. <br />5. Authoriz g the use will not <br />impose addit onal costs on the <br />public if it is necessary for the <br />public to to a the property,in <br />the future. <br />6. The app icant and user <br />agree to all c nditions that the <br />City Counci deems appropri- <br />ate for aut orization of the <br />interim use. <br />7. The ap licant provides <br />assurances eemed adequate <br />by the City ouncil that the <br />use will ter inate as provided <br />in the interi use permit. The <br />City Counci may require the <br />applicant t deposit a cash <br />amount wit the City, or pro- <br />vide some o her form of secu- <br />rity, to ens a compliance with <br />this criteria. <br />8. Authoriz tign of the interim <br />use will not result in adverse <br />effects on t e public health, <br />safety, or we are. <br />9.
