Box 490 <br />Elk River, Minnesota 55330-0490 <br /> <br />RE: 221sT AVENUE PAVING REQUEST <br /> <br />Dear Council Members: <br /> <br />Attached is a letter recently received from Marly Glines of Dynamics Design and Land <br />Company representing the developers of Ridges of Rice Lake. The letter requests that <br />the City pave 221s' Avenue from CSAH I to just east of their development entrance off of <br />221s' Avenue. The letter indicates that they would agree to pay one hundred percent for <br />the cost of this paving. This offer is the same offer that was outlined in the feasibility <br />study the City Council considered for the paving of the entire stretch of 221s' Avenue <br />several weeks ago. In that feasibility study, the offer from Dynamics Design and Land <br />Company was expressed as approximately half of the total length, rather than the 3,400 <br />feet indicated Mr. Glines' letter. <br /> <br />Staff has reviewed this offer and is of the opinion that there is very little downside risk in <br />allowing the developers to pay for the paving of 221s' Avenue. As the Council is aware, <br />if this paving takes place, there will be a stretch of approximately similar length in the <br />middle between Highway 169 and CSAH I which will remain gravel. There may be <br />some pressure from abutting property owners or vehicles traveling this route to pave this <br />stretch in the middle. We believe that if the Council allows Dynamic Design and Land <br />Company to pay for paving the west end, it will be very difficult at a future date to assess <br />the remaining piece. The most reasonable way to get the middle piece paved would be <br />to wait until there is development of the property on the north or south side of it and <br />make it a condition of the development that it be paved. <br /> <br />If the Council would like to accept this offer from Dynamics Design and Land Company, <br />this piece of 221't Avenue paving could easily be added to the City's overlay project <br />which is currently being advertised for bids. One further note, if the City Council would <br />like to reconsider the paving of the entire stretch with some type of assessments to the <br />abutting properties, either deferred or active, this unfortunately will not allow the meeting <br />of the schedule desired by Dynamics Design and Land Company.
