Professional service contracts generally result in a report or a completion of <br />specific tasks. (Minn. Stat. Section 16C.08, subd. 1). <br /> <br />Procurements under $25,000 may use an informal solicitation process. The informal solicitation <br />process has been defined by the Commissioner of Administration as a solicitation of three <br />informal proposals, with the award going to the best value. If the procurement is under $5,000, a <br />direct selection of a contractor may occur. <br /> <br />Procurements at $25,000 and above must use a formal solicitation process, inCluding'a sealed <br />cost proposal. Public notice must be made of the solicitation in the State Register and may be <br />made in other pertinent periodicals and trade journals. Notice must be given for a minimum of <br />21 days. Again, the award is based on best value, with the solicitation documents containing the <br />importance of cost and other factors evaluated. (Minn. Stat. Section 16C.06.) <br /> <br />3.1.2.2 Bids <br /> <br />Under Minnesota Statutes Section 16C.03, subdivision 3, an IFB must be used for building and <br />construction procurements. When using an IFB, the award must be made to the lowest <br />responsible and responsive bidder, while also considering conformity with specifications, ability <br />to deliver, the purpose for which the IFB was intended, the availability and capability of the <br />vendor, and any other considerations identified in the IFB. Life cycle costing may be used in <br />determining the lowest bid. <br /> <br />3.1.2.3 Sole-source <br /> <br />The State of Minnesota does have the authority to make sole-source, or "single source," <br />selections. A single source selection is defined as an acquisition where, after a search, only one <br />contractor is determined to be reasonably available (Minn. Stat. Section 16C.02, subd. 18). A <br />single source selection is only available if there is clearly and legitimately only one source for the <br />services and the cost has been fairly and reasonably established (Minn. Stat. Section 16C. 10, <br />subd. 1). <br /> <br />3.1.2.4 Negotiated Procurement <br /> <br />Under Minnesota Statutes Section 174.82, the Commissioner of Transportation is given the <br />authority to negotiate with railroads in order to facilitate the design, construction, operations, and <br />maintenance of the commuter rail system.
