L~UUO <br /> <br />2.1.4.3 Sole-source <br /> <br />Non-competitive procurement contracts may be awarded for goods and services, but only on an <br />exceptional and fully-documented basis. More specifically, non-competitive procurements are <br />permitted in the following circumstances: <br /> <br />Only one responsible source and no other supplier or services will satisfy <br />Mn/DOT's project requirements; <br /> <br />· There is unusual and compelling urgency caused by other than lack of advance <br /> planning; <br /> <br />· There is inadequate competition after solicitation of competitive proposals; and <br /> <br />· A capital maintenance item or compatibility with an existing system investment <br /> can only be obtained directly from the original equipment manufacturer. <br /> <br />2.1.5 Procurement Alternatives <br /> <br />Once the planning is completed for a project, and the general components for its implementation <br />are defined sufficiently to gain approval from the funding authority(ies) to proceed, then there are <br />several alternatives for procurement that can be used. <br /> <br />2.1.5.1 Design-Bid-Build <br /> <br />This is the conventional industry practice involving complete control by the public agency-owner <br />of the steps leading up to the bid award in the procurement process. The public sector is <br />responsible for the following: <br /> <br />· Planning and preliminary design; <br /> <br />· Environmental clearance; <br /> <br />· Preliminary engineering of infrastructure and performance specifications for <br /> system-wide elements and equipment; <br /> <br />· Final design of infrastructure; <br /> <br />· Right-of-way acquisition; and <br /> <br />· Funding. <br /> <br />The vendors and contractors prepare bids for the various construction packages. The lowest <br />responsible bidder is selected and a contract is awarded. The vendors and contractors fabricate, <br />construct, install, and test the system under the observation of the public agency.
