o. Utilities will furnish power to the meter. The applicant must pay for any. <br />- _ - - <br />electrical costs after the meter including usage and installation following Elk <br />River electrical code. <br />7. Any communication antenna or tower on Utilities owned property must adhere to <br />FAA established standards for the site. <br />Any maintenance or work done on the site will be done to Utilities standards. <br />V. Application Process <br />All applicants who wish to locate a communication antenna or tower on Utilities owned property <br />must submit to the Utilities Manager a completed application and detailed plan that complies <br />with the submittal requirements of the Zoning Ordinance along with other pertinent information <br />requested by Utilities. Granted applications will be subject to execution of a Lease for a fixed <br />term between Utilities and the applicant. At the end of the lease, the applicant will be required to <br />go through a renewal process and put in place a new lease with Utilities. <br />VI. Lease Rates <br />Lease Rates will be determined for each case based on the equipment needed, space required and <br />other considerations and requirements. <br />VII. Termination <br />Lease agreements will provide that Utilities may terminate the lease if it determines that any one <br />of the following conditions exist: <br />1. A potential user with a higher priority cannot find another adequate location and <br />the potential use would be incompatible with the applicant's use; <br />2. A user's broadcast unreasonably interferes with other users of a higher priority, <br />regardless of whether or not this interference was adequately predicted in the <br />technical analysis; or <br />A user violates any of the standards in this policy or the conditions attached to <br />Utilities permission. <br />Before taking action, Utilities will provide notice to the user of the intended termination and the <br />reasons for it, and provide 90 days for the applicant to have an opportunity to address Utilities <br />regarding the proposed action. This procedure need not be followed in emergency situations. <br />
