DRAFT` <br />• &UPPLIED: Paid for, furnished by, provided by, or under the <br />control of the owner, operator, or agent of a dwelling. <br />UNSAFE: As applied to a structure, a condition, or a combination <br />of conditions which are dangerous or hazardous to persons or <br />property. <br />UNSANITARY: Conditions which are dangerous or hazardous to the <br />health of persons. <br />1007.04 - ENFORCEMENT <br />1. General <br />A. Authoritv - The Building and Zoning Administrator is <br />hereby authorized and directed to enforce all of the <br />provisions of this ordinance. <br />The Building and Zoning Administrator shall have the power <br />to render interpretation of this ordinance and to adopt <br />procedures as he may deem necessary in order to apply the <br />provisions of this ordinance. Such interpretations and <br />procedures shall be in conformity with the intent and <br />purpose of this ordinance. <br />• B. Riaht of Entry - Whenever necessary to make an <br />inspection to enforce any of the provisions of this <br />ordinance, or whenever the Building and Zoning Administrator <br />or his authorized representative has reasonable cause to <br />believe that there exists in any building or upon any <br />premises any condition or code violation which makes such <br />building or premises unsafe, dangerous or hazardous, the <br />Building and Zoning Administrator or his authorized <br />representative may enter such building or premises at all <br />reasonable time to inspect the same or to perform any duty <br />imposed upon the Building and Zoning Administrator by this <br />ordinance, provided that if such building or premises be <br />occupied, he shall first present proper credentials and <br />request entry; and if the building or premises be <br />unoccupied, he shall first make a reasonable effort to <br />locate the owner or other persons having charge or control <br />of the building or premises and request entry. The property <br />owner of the premises shall notify tenants of the time and <br />purpose of the inspection. The tenant shall make the <br />premise accessible to the Building and Zoning Administrator. <br />If such entry is refused, the Building and Zoning <br />Administrator or his/her authorized representative shall <br />• have recourse to every remedy provided by law to secure <br />entry. <br />4. <br />
