DRAFT <br />• 7/24/95 <br />SECTION 1007 - HOUSING MAINTENANCE ORDINANCE <br />1007.00 - PURPOSE AND SCOPE <br />1. Purpose - The purpose of this ordinance is to provide <br />minimum standards to safeguard life, health, property, and public <br />welfare by regulating the occupancy and maintenance of all <br />residential rental buildings and structures within the City of <br />Elk River. <br />2. Scope - The provisions of this code shall apply to all <br />buildings or portions thereof used, or designed, or intended to <br />be used, for rental residential purposes. This ordinance does <br />not apply to owner occupied single family homes. <br />Where any building or portion thereof is used or intended to be <br />used as a combination apartment house-hotel, the provisions of <br />this ordinance shall apply to the separate portions as if they <br />were separate buildings <br />Every rooming house or lodging house shall comply with all the <br />• requirements of this Code for dwellings. <br />A. Additions, Alterations, or Rex~airs - For additions, <br />alterations, or repairs, see the Building Code. <br />B. Relocation - Buildings or structures moved into or <br />within this jurisdiction shall comply with the requirements <br />in the City Code of Ordinances and the Building Code for new <br />buildings and structures. <br />C. Continuation of Use - Dwellings in existence at the <br />time of the adoption of this ordinance may have their <br />existing use or occupancy continued, if such use or <br />occupancy was legal at the time of the adoption of this <br />ordinance, providing such continued use is not dangerous to <br />life, health, property, or public welfare. <br />1. Definitions - For the purpose of this ordinance, certain <br />terms, phrases, words and their derivatives shall be construed as <br />specified in either this Section or as specified in the Building <br />Code and elsewhere in the City Code of Ordinances. Whenever the <br />words "dwelling", "dwelling unit", "premises", or "structure" are <br />• used in this ordinance, they shall be construed as though they <br />were followed by the words "or any part thereof."
