Memo To The City Council Page 2 <br />July 17, 1995 <br />• the north, an outlot was deeded to the city to cover a portion of the regional <br />pond. that extended onto that plat. Deeding of Outlot B to the city will <br />complete the assemblage of property for the regional pond site. <br />The developer is requesting to retain ownership of Outlot A. This outlot can <br />then be attached to the office building site immediately to the north, in the <br />plat of Hillside Crossings South. Apparently, the potential business for the <br />office building is requesting use of the upland portion of Outlot A for a <br />monument sign to identify the business. <br />To accommodate storm drainage from Outlot B to the MNDOT right-of--way, a <br />drainage and utility easement will be necessary through Outlot A. Staff <br />would recommend that all of Outlot A except that part above the 100-year <br />flood elevation. be encumbered with this drainage and utility easement to <br />accommodate whatever drainage needs will be necessary for the regional <br />pond. By platting this property as an outlot it cannot be considered <br />buildable; therefore, it should not be altered other than placing a sign. <br />Development Fees <br />Since the preliminary plat was approved by the City Council a little more <br />than two years ago, some development fees have been amended. The <br />development fees in the recommendation reflect the current fees. This has <br />been done on other plats when the fees have changed between the time of <br />preliminary and final plat. <br />Recommendation <br />It is recommended that the City Council approve Resolution No. 95- , <br />granting final plat approval for Cherryhill Bluffs 4th Addition, with the <br />following conditions: <br />1. A developers agreement be prepared and executed, outlining the terms <br />and conditions of approval. <br />2. Park dedication fee's in the amount of $8,000, be paid prior to <br />recording the final plat. <br />3. A surface water management impact fee in the amount of $1,977.60, <br />be paid prior to recording the final plat. <br />4. A water access charge in the amount of $4,800, be paid to Elk River <br />Municipal Utilities prior to recording the final plat. <br />• 5.
