On <br />October 30, 1996 the City served James and Kirt Charest an order under the <br />Hazardous Property State Statute (Minn. Stat. 463.15) to clean-up the <br />property within thirty days. The law provides the City the ability to obtain a <br />court judgment allowing the City to remove the hazardous condition at the <br />site, if the order is not complied with in the specified 30 days. <br /> <br />A site inspection by Stephen Rohlf and City Attorney Kevin Johnson on <br />December 3, 1996 found progress on the clean-up of the property <br />unacceptable. Approximately forty junk vehicles remain on the site. Staff <br />will provide pictures from this inspection to the Council at Monday night's <br />meeting. <br /> <br />Staff recommends the City seek a court judgment that allows it to <br />clean-up this site. Staff cautions the Council that this clean-up will be <br />costly.
