The Planning Commission voted in favor (5-2) of the request for a Commercial Dog Kennel Conditional
Use Permit.
Since the Planning Commission meeting, staff has had conversations with the City Clerk and the City
Attorney and is recommending two additional conditions:
• Applicant shall provide proof of liability insurance in at least the sum of $1 million.
• No dogs designated as dangerous or potentially dangerous are allowed to be kept at the
kennel and keeping of a dangerous or potentially dangerous dog shall be grounds for
revocation.
Public Comment
Several neighbors expressed concern about the barking noise and the number of dogs. They also stated it
is not the size of the lot that is significant, but the proximity to neighbors. The subject property and the
property to the south are each near 10 acres in size, but the house on the neighboring lot is only 140-145
feet away from the one kennel. One comment was there are so many dogs so close to so many
neighbors.
The applicant stated the dogs are not out at night for more than 15 minutes at a time, there are other
barking dogs around, their puppies are the ones that bark, and that all the animals would be their pets.
He later stated that they would be breeding dogs for sale.
Attachments
• Staff Report to Planning Commission dated September 15, 2009
• Email from Larry and Roxy Brown
Action Motion by Second by Vote
Follow Up
S:\PLANNING MAIN\Case Files\CUP\CU 09-18 Fahey Kennel\CU 09-18_CC.doc
