1. PURPOSE <br />It is the purpose of this handbook to establish a uniform and equitable system of <br />personnel administration for employees of Elk River Municipal Utilities. It is the policy <br />of the Elk River Municipal Utilities not to discriminate in employment matters on the <br />basis of race, creed, color, age, marital status, national origin, sex, status with regard to <br />public assistance, or disability. <br />2. INTENTION OF THE UTILITY REGARDING POLICIES AND <br />EMPLOYMENT <br />The foregoing policies are unilaterally created and implemented by the Utility and are <br />intended to serve only as guides for employment. THE POLICIES ARE NOT TERMS <br />AND SHALL NOT BE REGARDED AS OR CONSTRUED AS CONTRACTUAL <br />PROVISIONS. AS GUIDES, THE PROVISIONS MAYBE CHANGED AT ANY TIME BY <br />A MAJORITY VOTE OF THE UTILITIES COMMISSION <br />This handbook is not a contract but is intended solely to give eligible employees a short <br />description of the working conditions at this place of employment. If at any time there <br />should be a conflict between a description in this booklet and a labor contract, personnel <br />policy, or both, the terms of the actual contract or personnel policy will govern in all <br />cases. <br />3. UTILITIES COMMISSION RESPONSIBILITIES <br />The Utilities shall in accordance with its statutory responsibility to manage the Utility, be <br />responsible for the maintenance and periodic revision of personnel policy and the <br />Utility's personnel program. <br />4. SEXUAL HARASSMENT <br />PURPOSE; It is the Elk River Municipal Utilities policy that the work force <br />environment and the Utilities employees will be free of sexual harassment and <br />that all individuals will be treated with respect. <br />POLICY,' The Utilities policy is that: Sexual harassment of employees is <br />prohibited. This policy will apply to all officials and employees of Elk River <br />Municipal Utilities. Sexual harassment includes, but is not limited to, unwelcome <br />sexual advances, requests for sexual favors, sexually motivated physical contact, <br />and other verbal, visual or physical conduct of a sexual nature when: <br />a. Submission to such conduct is made either implicitly or explicitly a <br />term or condition of an individual 's employment; <br />b.
