�REE�OOLLPI'ION 09-42 <br />AR ESOLUTION OF THE <br />CITY OF ELK RIVER <br />A RESOLUTION <br />Uq%OVIING NOTICE OF <br />.UbUdMY PUBLICATION <br />OF ORDINANCE 1100 -08 <br />AN ORDINANCE <br />AMENDING CHAPTER 10 <br />OF THE ELK RIVER CITY <br />CODE TO REGULATE <br />DANGEROUSAND <br />POTENTIALLY <br />DANGEROUS DOGS <br />WHEREAS, on August. 17, <br />2009 the `Elk River City Coun- <br />cil adopted Ordinance 09 -08 <br />amending Chapter 10, of the <br />Elk River Code of Ordinances <br />which regulates dangerous and <br />potentially dangerous dogs; and <br />WHEREAS, the purpose of the <br />ordinance is to protect the <br />health, safety, and welfare of <br />citizens'by incorporating the <br />provisions of Minnesota Stat- <br />utes, Section 347.50 to 347.565 <br />in the City Code, placing <br />restrictions on.dangerous and <br />potentially dangerous dogs and <br />their owners; and <br />WHEREAS, the ordinance <br />outlines the process for declar- <br />ing dangerous and potentially <br />dangerous dogs, licensing <br />requirements to owners,, <br />restrictions that must be fol- <br />lowed", fees and expenses fore <br />covering the city's cost, due <br />_rocess hearing rights, animal <br />`zure, owner reclaiming an <br />imal, destruction of certain <br />dogs, and penalties; and <br />WHEREAS, a copy of the full; <br />text of the ordinance is avail- <br />able for inspection by any per- <br />son at the office of the'Elk <br />River City Clerk, 13065 Orono <br />Parkway, during regular busi- <br />ness hours 8:00 a.m. to 4:30 <br />p.m.; Monday through Friday; <br />and <br />NOW, THEREFORE, BE IT <br />RESOLVED, that the City <br />Council, by alt least four -fifths <br />vote, authorizes the publics- <br />don of the title and summary of <br />Ordinance 09 -08 and that <br />Ordinance 09 -08 shall become <br />effective upon publication of <br />this resolution. <br />Passed and adopted this 17th <br />day of August 2009. <br />Stephanie Klinzing, <br />Mayor <br />ATTEST: <br />Tina Allard, <br />City Clerk <br />(Ag29) <br />AFFIDAVIT OF PUBLICATION <br />STATE OF MINNESOTA <br />COUNTY OF SHERBURNE <br />SS <br />Heidi Quanrud, being duly sworn on oath says that she is the office manager of the <br />Newspaper known as the Star News, and has full knowledge of the facts which are stated <br />below: <br />(A) The Newspaper has complied with all ofthe requirementsconstituting qualifications <br />as a qualified newspaper, as provided by Minnesota Statue 331A.02, 331A.07 and other <br />applicable laws, as ammended. <br />(B) The printed Resolution 09 -42, which is attached was cut from the columns of said <br />newspaper and was printed and published once a week for one week; it was first published <br />on Saturday, the 29th day of August, 2009, and was therefore printed and published on every <br />Saturday to and including Saturday, the 29th day of August, 2009, and printed below is a <br />copy of the lower case alphabet from A to Z, both inclusive, which is hereby acknowledged <br />as being the size and kind of type used in the composition and publication of the notice <br />abcdefghij klmnopgrstuvwxyz <br />Office Manager <br />Subscribed and sworn to before me on "Ail CINDY M.
