I-Ylill fully comply with all other requirements of this Code, including any a~iplicahle requirements and <br />standards for the issuance of a license or permit to establish and operate the proposed use in the city. <br />If denial of such a permit should occur, it shall accompany recommendations or determinations by <br />findings or a report stating how the proposed use does not comply with the standards set forth in <br />Section 30-654. <br />In the review of the standards for CUP as outlined, it appears that the request is consistent with all <br />of these standards. <br />Analysis <br />The proposed project is the relocation of the existing Subway located in the BP Convenience store <br />directly east of the subject property. The new Subway location would be a more traditional Subway <br />Restaurant with dine-in seating. <br />The building and site is set up for adrive-thru window, but the applicant is currently choosing not to <br />provide that service. However, if the drive-thru is desired in the future, the site can accommodate <br />the stacking of cars. It is suggested that the CUP be written to allow the Drive Through in the <br />future, without the need fox a revised CUP. <br />Access into the building will be on the north side of the building and the facility will have seating for <br />up to 42 customers <br />Tran~ortation <br />Access to the site is off of both Joplin Street and Business Centex Drive. The vehicular circulation <br />has already been reviewed and approved for the subject site. There is adequate vehicular circulation <br />in and around the site. The overall parking was taken into account when the existing project was <br />built and there appears to be sufficient area fox the proposed use. Parking will be shared with other <br />tenants of the shopping center. <br />Comprehensive Plan <br />The Highway Business land use is the most intensive form of commercial development in Elk River. <br />Businesses in this category may be the largest both in terms of size and traffic generation. Market <br />orientation tends to be regional in nature. Development orientation tends to be toward regional <br />highways. Future Highway Business developments should be located within the Urban Service <br />Boundary and adjacent to regional highways.
