• - The potential for contamination of groundwater discharging to the Rice <br />Lake/Tibbits Brook wetland complex due to the development of the SDA is <br />remote. A hydrogeologic investigation performed by the MPCA as part of the <br />EIS determined that only a very small portion of groundwater from the SDA <br />can move to discharge at the Rice Lake/Tibbits Brook wetland complex. One <br />or more monitoring wells will be situated between the SDA and the complex <br />to provide for early detection of any releases. <br />- No wetlands that would require mitigation under the Wetland Conservation <br />Act will be impacted. A small (<1 acre) wetland is located in the southwest <br />corner of the site adjacent to the abandoned railroad bed. No impacts are <br />proposed to this wetland. This wetland has not been formally delineated. <br />If necessary, prior to obtaining any construction permits the wetland will be <br />delineated to formally establish the boundary and the grading plan adjusted <br />if necessary. <br />- Oak Wilt Prevention. As a method to prevent oak wilt, ERL will not conduct any tree <br />removal operations at the landfill property between April 15 and July 15 each year. <br />In addition, oak stumps will be removed prior to April 15 each year. When removing <br />trees and stumps, ERL will prevent damage to remaining trees. <br />(7) Will fully comply with all other requirements of this Code, including any applicable <br />requirements and standards for the issuance of a license or permit to establish and operate the <br />proposed use in the city. <br />The Elk River Landfill has in place an approved Conditional Use Permit (April 21, 2008) and Solid <br />Waste Facility License Agreement. With development of the SDA, the Landfill will continue to <br />• operate as it has in the past, in accordance with City requirements. <br />Construction of the SDA will require other state, county, and local permits and approvals. Permits <br />and approvals from the MPCA include modification of the Solid Waste Disposal Facility permit, <br />NPDES General Stormwater Permit for Construction, modification of the NPDES General <br />Stormwater Permit for Industrial Activity, and amendment of the Title V Air Permit, and a <br />Certificate of Need (CON) for development of the entire SDA. A CON has already been issued for <br />a portion of the SDA capacity. The Metropolitan Council Environmental Services Industrial <br />Discharge Permit will require modification as well as the ERL's Sherburne County Solid Waste <br />License will require modification.
