The revised landfill footprint has relocated other features associated with the facility, • <br />such as the location of on-site sedimentation ponds, berms, and roadways. The revised <br />layout of these elements, as shown on the site development plans, keeps the same <br />general configuration as shown on the 2008 conceptual end use drawings, however, <br />allows for additional room for future commercial development opportunities along TH 169 <br />and 221St Avenue. <br />The end use concepts presented in Exhibit 5 provide for passive open space and recreational <br />uses of the majority of the site, with commercial opportunity at the intersection of TH 169 and <br />221St Avenue. Long term, the proposed open space planned for the site would be compatible with <br />any adjacent future residential development to the west, and actually provide an amenity for <br />future residents. The end use concepts provide for public access of the spectacular view of the <br />Rice Lake wetland complex to the west of the site that would otherwise not be visible from any <br />other vantage point. The open space and recreational uses will be integrated into the planned <br />trail system, which includes the potential for a trail connecting the existing neighborhoods to the <br />west of the SDA to the City's Railroad Hiking Trail. These end use plans may be implemented in <br />phases as the ERL closes the landfill. <br />The ERL has site-specific provisions in place for the closure of the existing landfill in accordance <br />with their site permits, as well as for the maximum gas production benefits for the community. In <br />addition, the ERL has guaranteed these closure activities, as well as post-closure care and <br />potential contingency actions that may be required through the use of a surety bond in <br />accordance with the financial assurance requirements by the MPCA. Closure plans for the existing <br />landfill have previously been approved by the MPCA, Sherburne County, and the City of Elk River. <br />As the ERL enters the phased closure of the SDA and initial end uses for the site are • <br />implemented, fencing may be utilized to separate the operation of the ERL from the end uses. <br />After final closure of the ERL, security at the ERL will focus more on the passive recreational <br />access to the site, if that is the selected end use. The ultimate fencing requirements associated <br />with the end use will likely focus more on safety.
