REQUEST FOR ACTION <br />To Item Number <br />Ci Council 8.2. <br />Agenda Section Meeting Date Prepared by <br />Administration Ma 18, 2009 Lori ohnson, Ci Administrator <br />Item Description Reviewed by <br />Shared Personnel Agreement Between the City of Elk River and <br />Elk River Municipal Utilities (ERMU) Regarding the City's Reviewed by <br />Public Works Director and ERMU's Water Department <br />Action Requested <br />Approve Shared Personnel Agreement between the City of Elk River and Elk River Municipal Utilities <br />(ERMU) regarding the City's Public Works Director and ERMU's Water Department (Agreement). <br />Background/Discussion <br />The Elk River Municipal Utilities Commission requested that the City Council consider entering into an <br />agreement to have the City's public works director supervise the water superintendent and provide <br />management services to the water department. The Council considered this request in March and directed <br />staff to work with the ERMU to draft an Agreement for those services. <br />City Attorney Peter Beck drafted an Agreement for the services requested by ERMU. The Agreement <br />has subsequently been reviewed and revised by the ERMU staff and the Commission. The ERMU <br />Commission approved the Agreement at its meeting on May 12. <br />The Agreement provides for services that are somewhat reduced from those originally proposed by <br />ERMU. The Agreement states that the water superintendent will be under the direct supervision of the <br />public works director and that the City will provide assistance with management of the Elk River water <br />system through the public works director. The public works director will continue to report to and work <br />under the city administrator. The water utility remains under ERMU. Attachment A includes a list of the <br />services to be provided to ERMU by the public works director. Payment for services will be $1,000 per <br />month initially; payment will be reevaluated after six months based on actual hours of service provided. <br />This Agreement may be cancelled by either party with 60 days written notice. The Agreement also <br />includes an automatic renewal clause for successive one year terms. <br />City staff is prepared to offer these services to ERMU as stated in the Agreement. During the time the <br />City is under contract for public works director services with BDM Consulting, there will be no additional <br />charge from BDM. The time anticipated to be spent on water issues is relatively minor, and there is <br />adequate time allowed within the BDM contract. At such time when the City employs a public works <br />director, these duties would merely be another function of that position and would be included in the job <br />description.
