Mortgaged Property, or the creation of any easement thereon, or any covenants restricting use or <br />occupancy thereof, or agree to alter or amend the terms of this Mortgage in any way, all without <br />in any way affecting the liability of any person (other than the person so released), or the validity <br />or priority of this Mortgage (except as it covers property so released). Any personal property <br />remaining upon the Mortgaged Property, after the Mortgaged Property has been possessed or <br />occupied by Mortgagee or its agent following foreclosure of this Mortgage, or under any deed in <br />lieu of foreclosure, shall be conclusively presumed to have been abandoned by Mortgagor. <br />25. OTHER DEBT. This Mortgage shall also secure, and the Indebtedness shall also <br />include, any and all other advances heretofore or at any time hereafter made to Mortgagor by <br />Mortgagee, and all other Indebtedness of any and every type and description now or hereafter <br />owed to Mortgagee by Mortgagor, unless (in the case of any such advance or indebtedness) <br />Mortgagee has otherwise agreed in writing; provided, however, that notwithstanding such <br />provision, Mortgagee shall not be obligated to make any such advance or to permit or suffer the <br />creation of any such indebtedness. <br />26. FIXTURE FILING. From the date of its recording, this Mortgage shall be effective <br />as a financing statement filed as a fixture filing with respect to all goods constituting part of the <br />Mortgaged Property, as described above, that are or are to become fixtures, related to the real <br />estate described herein.
