1) Antitrust laws including any and all claims for overcharges as to goods and/or <br />services provided in connection with this contract resulting from antitrust <br />violations which arise under the antitrust laws of the United States and the <br />antitrust laws of the State of Minnesota. <br />2) Unacceptable Risk. Borrower assures that Contractors and Subcontractors shall <br />not be listed on the "unacceptable risk determination" list of the U.S. Department <br />of Housing and Urban Development. <br />3) Equal Employment Opportunities: Section 109, Housing and Community <br />Development Act of 1974 -Civil Rights Act of 1964. Borrower shall ensure that <br />employees and applicants for employment are not discriminated against because <br />of their race, color, creed, sex or national origin. This contract includes as <br />attachments all equal opportunity clauses required under law. <br />4) Contractor Work Hours and Safety Standards Act. Borrower shall ensure <br />compliance with Contract Work Hours and Safety Standards Act (40 USC <br />327-330) as supplemented by Department of Labor Regulations 29CFR, Part 5. <br />These regulations briefly state the following: <br />i) Section 107 of the Act provides that no laborer or mechanic shall be <br />required to work in surroundings or conditions which are unsanitary, <br />hazardous, or dangerous to health and safety. <br />ii) Davis-Bacon Act, Copeland Anti-kickback Act. Which relate to prevailing <br />wages and permissible deductions for workers on construction projects with <br />federal funds. <br />iii) Borrower shall assure that Contractors shall be required to compute the wages <br />of every mechanic and laborer on the basis of a standard work week of forty <br />(40) hours. Work in excess of a standard work week is permissible provided <br />that the worker is compensated at a rate of not less than one and one-half (1 <br />1 /2) times the basic rate of pay for hours worked in excess of forty (40) hours <br />in the work week. <br />5) Section Three Clause. Borrower is to comply with provisions of Section 3 of the <br />Housing and Urban Development Act of 1968 which briefly states the following: <br />i) Contractor is encouraged to hire and train Section 3 covered (local) lower <br />income residents. <br />ii) Contractor is encouraged to utilize Section 3 covered (local) businesses for <br />materials. <br />9 <br />
