Mortgagor further covenants and agrees that: <br />(a) Mortgagor represents and warrants that (i) Mortgagor's exact legal name as <br />indicated in the public record in the jurisdiction in which Mortgagor is organized, if any, is <br />as set forth in Section 25 hereof, and (ii) all information in Section 25 hereof with respect <br />to Mortgagor's type of organization, jurisdiction, organizational identification number, and <br />address is accurate. <br />(b) Mortgagor covenants that (i) Mortgagor will not change its name, place of <br />business, chief executive office, mailing address, or organizational number, if any, without <br />providing not less than thirty (30) days' prior written notice to Mortgagee, and (ii) <br />Mortgagor will not change its type of organization, jurisdiction of organization, or other <br />legal status without the written consent of Mortgagee. <br />(c) Mortgagor covenants that Mortgagor will operate and maintain the Mortgaged <br />Property during the term of the Indebtedness so that it is eligible at all times for the low- <br />income housing credits provided by Section 42 of the Internal Revenue Code of 1986, as <br />amended, for at least Thirty two (32) units. <br />(THE REMAINING PORTION OF THIS PAGE IS INTENTIONALLY LEFT BLANK) <br />Development Name, City <br />LMIR-Combination Mortgage, Security Agreement <br />and Fixture Financing Statement <br />Dev. # <br />I ( Date_ <br />
