~ty of <br /> <br />iver <br /> <br />MEMORANDUM <br /> <br />ITEM 5.4. <br /> <br />TO: <br /> <br />FROM: <br /> <br />DATE: <br /> <br />SUBJECT: <br /> <br />Mayor and City Council <br /> <br />Stephen Rohl£, Building and <br />Zoning Administrator <br /> <br />July 22, 1996 <br /> <br />Acquisition of a Portion of <br />Hillside Park by Sherburne <br />County Highway Department/P.H. <br /> <br />Sherburne County is proposing to upgrade County Road # 12 to County <br />State Aid (CSA) standards in 1997. To meet these standards the hill <br />adjacent to Hillside Park will need to be lowered. <br /> <br />Just to the east of the park there is an existing driveway that is already very <br />steep. This driveway serves three residences. If the county road is lowered <br />as proposed the driveway will be at an intolerable 15% grade. <br /> <br />The County is proposing to relocate the driveway to the east and bring its <br />grade down to less than 10%. To do this they would need to cut through the <br />southeast corner of Hillside Park (see attached drawing). The County is <br />requesting to acquire the property necessary to accomplish this. <br /> <br />The City acquired this property from a Irma F. Dickey on May 6, 1952. No <br />restrictions regarding park were placed on this purchase. <br /> <br />The Planning Commission has already reviewed this issue and determined <br />this acquisition does not affect the Park Plan or Comprehensive Plan. <br />For safety reasons staff and the Park and Recreation Commission are also <br />recommending approval of the County's request with the following <br />conditions: <br /> <br />That the City does not retain ownership of the property the driveway <br />crosses. The County is proposing to include this property as County <br />right-of way in a plat. <br /> <br />o <br /> <br />That a fair price for this property and additional land the County will <br />need to acquire to increase their R-O-W from 33 feet from centerline to <br />50 feet is negotiated.
