Phoenix Enterprises LLC Request to Modify Fence Requirements in Hillside
Crossin,q PUD

City Planner Steve Ach indicated that the city has received a request from
Riverside Development to modify the fence requirements around the storm
water pond in the Hillside Crossing Planned Unit Development. He explained
that the plans for the Hillside Crossing PUD included a storm water ponding area
that would be surrounded by a four foot high fence on the west, north, and east
sides and a six foot high fence on the south side. Steve Ach explained that the
developers are requesting to change the fencing requirement by reducing the
height of the fence along 193rd from 6 feet to 4 feet and by eliminating the
fence along the east portion of the pond.

The Council discussed the issue and felt that the elimination of the fence along
the one side of the pond could create extra liability for the city.

COUNCILMEMBER SCHEEL MOVED TO DENY THE REQUEST TO MODIFY THE FENCE
REQUIREMENTS AROUND THE STORM WATER POND IN THE HILLSIDE CROSSING
PLANNED UNIT DEVELOPMENT. MAYOR DUITSMAN SECONDED THE MOTION. THE
MOTION CARRIED 2-0-1. Councilmember Dietz abstained.

8.
