ITEM 5.7. <br /> <br />~ity of <br /> <br />River <br /> <br />FROM: <br /> <br />DATE: <br /> <br />SUBJECT: <br /> <br />MEMORANDUM <br /> <br /> Mayor & City Council <br /> <br /> Pat Klaers, City ~~lstrator <br /> June 3, 1996 //~ <br /> Dwight Kirkeide Requests <br /> <br />A number of meetings ago, Dwight Kirkeide came before the City Council <br />with some issues that he needed resolved. These issues included street <br />signage off of Highway 10, garbage collection service, identification on the <br />911 system, and determination of the legal status of the road/cart path that <br />accesses his home. <br /> <br />The street/park superintendent has advised me that a 173rd Avenue street <br />sign has been installed off of Highway 10 at the access point to the Kirkeide <br />homesite. <br /> <br />The fire chief has advised me that this homesite is now identifiable on the <br />911 system. The fire chief has worked with the county to ensure that this <br />location "shows up on the system" if an emergency takes place and 911 is <br />dialed. <br /> <br />Staff recommends that Mr. Kirkeide be exempt from the city mandatory <br />garbage and recycling service beginning in 1996. The 1995 fees have been <br />assessed against this property. <br /> <br />The main issues with Mr. Kirkeide appear to be resolved. The legal issue <br />regarding the status of the cartway may take more time. There is more than <br />one cartway issue in the City of Elk River so we need to be careful on how <br />this one is resolved. For example, if the cartway is abandoned, the property <br />goes to the adjacent landowners. If this happens, there is no legal access to <br />the Kirkeide property. On the other hand, if the cartway is declared a public <br />street, the city is obligated to maintain it. Additionally, if the street is <br />upgraded to city standards, the benefited property owners are assessed. <br />These are just a few of the legal issues that need to be sorted out and this <br />situation is an example of why the city discourages long private roads or <br />easements across other properties for access to single family home sites. <br /> <br />council:kirkeid <br /> <br />13065 Orono Parkway · P.O.
