As Figure 6 shows, the state Constitution allows five percent of the total HUTDF revenues to be <br />allocated "off the top" and apportioned among the three funds (trunk highway, county state aid and <br />municipal state aid). The allocation of the five percent special fund is made on the basis of a statutory <br />formula that the legislature may change only once every six years. The last change was made in 1998, <br />so it will be up for reconsideration in the 2004 legislative session. The current distribution of the 5 <br />percent special distribution is as follows: <br /> <br />16% to the Town Bridge Account <br />30.5% to the Town Road Account <br />53.5% to the Flexible Highway Account (used to restore former state trunk highways that have <br />been reverted to cities and counties and designated as MSA and CSAH system roadways. <br />These are referred to as "turnbacks".) <br /> <br />As illustrated in the chart, the distribution of the remaining 95 percent of the revenue in the HUTDF is <br />distributed as follows: <br /> <br />· 62% to the Trunk Highway Fund <br />· 29% to the County State Aid (CSAH) fund <br />· 9% to the Municipal State Aid (MSA) fund only for those cities with a population over 5,000. <br /> <br />Statutory Distribution of Funds Among Minnesota Cities <br />The total distribution of dollars provided by Minnesota cities and counties is governed by the State <br />Constitution, however, the Legislature determines the distribution among Minnesota's cities and <br />counties by formulae that are established by state law.
