TO: <br /> <br />FROM: <br /> <br />DATE: <br /> <br />SUBJECT: <br /> <br /> MEMORANDUM <br /> <br />Mayor and City Council <br /> <br />Terry Zajac, Senior Building Inspector <br /> <br />March 24, 2003 <br /> <br />Adoption of the Minnesota State Building Code <br /> <br />Item 5.1. <br /> <br />Attached is an Ordinance amending Chapter 30 "Land Development", Article II "Buildings <br />and Building Regulations", Division 1, Sections 30-61 through 30-83, which deal with the <br />application, administration and enforcement of the Minnesota State Building Code. <br />Sometime in 2003, the State of Minnesota will be converting from the Uniform Building <br />Code to the International Building Code (for industrial, institutional and commercial) and <br />the International Residential Code. The City of Elk River is mandated to switch to the new <br />codes when the state does. Attached to this memorandum is a handout from the <br />International Code Council that explains some of the benefits of the new codes. <br /> <br />The attached Ordinance Amendment is worded such that, in the future when the State <br />Building Code changes, the code the city enforces will automatically change (a self- <br />perpetuating ordinance). Fees related to building permits are established through the city's <br />fee resolution and are not affected by this ordinance amendment. <br /> <br />There are three optional sections to the new building code: Minnesota Rules Chapter 1306 <br />"Fire Protection Systems" and Chapter 1335 "Floodproofmg Regulations and appendix <br />chapter K "Grading". Staff is only recommending the adoption of 1335 "Floodproofmg" <br />at this time. <br /> <br />The Building Department did discuss the Fire Protection Systems section with Bruce West, <br />Elk River Fire Chief. In the future, the Fire Chief will be bringing forward an ordinance <br />amendment on Chapter 22 titled, "Fire Prevention and Protection", which will adopt by <br />reference the International Fire Code. <br /> <br />Staff recommends the City Council adopt the attached Ordinance Amendment as <br />submitted. I will be glad to answer any further questions you have at or prior to Monday <br />night's meeting. <br /> <br /> <br />
