Solution No. 8: Determine your Dwn community standards and <br />adopt these standards as your local laws. <br /> <br /> Comment: As a result'of small but remarkably ei~fective <br />changes in the federal law obtained by the sign industry, the act <br />has essentially become a billboard protection and proliferation <br />act. <br /> <br /> The federal act does not and most state acts do not preempt <br />local laws, as a general rule. The leverage against, local sign <br />laws is a financial one, in effect a .~.hreat of loss of highway .... <br />construction funds, or in the case of a few state laws, requiring <br />payment of cash compensation instead of amortization of existing <br />non-conforming billboards. <br /> <br /> Leqal Pitfall No. 8: Last but not least; failing to <br />involve your municipal lawyer early in the process. <br /> <br /> Comment: Sign control does not have to be complicated, but <br />it can be a futile attempt if certain basic legal principles are <br />not followed. Your local government lawyer should be able to <br />assure you that you are operating within the traditional <br />legislative powers of the state, and should be able to avoid <br />conflicts with federal and state constitutions. If the lawyer <br />feels insecure, at least the lawyer can seek help from other <br />lawyers who have been through some sign-control experiences. <br />There is no such thing as a dumb question; don't be afraid to <br />ask.
