They <br />are as follows: <br />1. Consider adoption of Resolution Accepting Bid and Authorizing Execution of Contract <br />2. Approve Supplemental Agreement, reducing the construction cost for the project <br />3. Authorizing the expenditure of $7,500 to purchase temporary easement on the Howse <br />property <br />Background/Discussion <br />Competitive bids were opened for the construction of the 193`d Avenue Improvement project on <br />Monday, October 13, 2008. There were a total of 16 bids received. The total bids ranged from <br />$3,895,777.01 up to $5,018,730.65 (a copy of the full bid tabulation is attached). The low bid was <br />received from R.L. Larson Excavating. R.L. Larson Excavating has successfully completed <br />similar projects within the City of Elk River and we are prepared to recommend award to them as <br />the lowest responsible bidder. We have received all of the approvals necessary from MnDOT to <br />proceed with the award. <br />In analyzing the total bid, the prices are in line with what was anticipated with the exception of an <br />area of approximately 500 feet long near the intersection with CSAH 13 at the eastern end of the <br />project. This is an area where soil borings taken after we received court-ordered access to the <br />property indicated a pocket of unsuitable soils that extended at one point to a depth of <br />approximately 20 feet. The area is in an existing wetland. In order to remove the unsuitable soils, <br />protect the wetland, and stay within the right-of--way acquired by the city, contractors were asked <br />to use innovative approaches, including sheet piling if necessary, for the construction of this <br />portion of roadway. Once the total cost of this construction was realized, we immediately began <br />discussing other options with our geotechnical consultant and began meetings with the apparent <br />low bidder, R.L. Larson Excavating. Through these discussions, we have gone back to the <br />Wetland Technical Evaluation Panel and asked for a modification, allowing us to disturb more <br />wetland as long as it is restored after construction. We have received an amendment to our <br />approved plan for this change. We have also worked with our eminent domain attorney, Howard <br />Roston, who has been in contact with the attorney for the Howse property. They have indicated <br />a willingness to provide the necessary temporary easement in exchange for $7,500 to construct the <br />roadway without any innovative techniques. Through these efforts we have been able to <br />negotiate a substantial contract price reduction included in Supplemental Agreement No. 1. <br />
