REQUEST FOR ACTION <br />To Item Number <br />Ci Council 7.1. <br />Agenda Section Meeting Date Prepared by <br />Administration Se tember 15, 2008 Tina Allard, Ci Clerk <br />Item Description Reviewed by <br />Consider Massage Therapist License for Jennifer Firkus -Salina Lori ohnson, Ci Administrator <br />Salon & Spa Reviewed by <br />Action Requested <br />Approve or deny a massage therapist license to Jennifer Firkus. <br />If Approved <br />Approval of the license should be contingent upon receiving proof the applicant has successfully <br />completed a minimum of 500 hours course work related to the theory and practice of massage. <br />If Denied <br />The denial should be based on findings. Following are some suggested findings: <br />Per Section 38-7 of the City Code <br />Applicant does not meet the standards for good moral character and is unable to serve the <br />public in a fair, honest, and open manner. <br />^ Per Section 38-224 (d) of the City Code <br />Applicant has been convicted or pled guilty within 3 years for crimes under MN Statute Chapter <br />609 or a crime involving moral turpitude. <br />1'erMN Statute 364.03 <br />The applicant's crimes relate to the type of license the applicant is pursuing. <br />Background/Discussion <br />Police Chief Beahen completed a background investigation on the applicant and is recommending denial <br />of her request for a massage therapist license. He will be at the meeting to explain his recommendation. <br />The applicant has signed off on forms allowing the release of her investigation report. <br />All application materials have been submitted with the exception of a copy of the diploma. If the <br />application is approved, it should be contingent upon receiving proof that the applicant has completed at <br />least 500 hours of course work related to the theory and practice of massage. <br />If denied, the applicant will be sent a letter outlining the Council's action and her right to appeal the <br />decision.
