REQUEST FOR ACTION <br />To Item Number <br />Ci Council 5.3. <br />Agenda Section Meeting Date Prepared by <br />Community Develo ment Se tember 15, 2008 Chris Leeseber ,Park Planner-Planner <br />Item Description Reviewed by <br />Request by Anchor Sign for Conditional Use Permit to Amend erem Barnhart, Plannin Mana er <br />signage for Elk River Crossing (Dollar Tree), Case No. CU 08- Reviewed by <br />18 - Public Hearing <br />Action Requested <br />Staff recommends that the City Council deny the Planned Unit Development (PUD) Agreement <br />amendment request, as illustrated on drawings dated 7-24-08, for the following reasons: <br />1. The retail space currently is allowed signage which is visible from Zane Street, Highway <br />169, and various locations in the development. <br />The Planning Commission recommends approval. <br />Summary <br />The PUD Agreement was created and entered on December 21, 1999. The development standards <br />regulate the typical items such as building materials, lighting, and signage. This PUD agreement <br />specifically identifies the subject site, the retail building attached to the north .ride of the proposed home improvement <br />store, for signage. <br />The applicant is looking to amend the PUD agreement to allow signage on the side of the retail building <br />that is attached to Home Depot. <br />Planning Commission Discussion <br />The Commission members that voted for the amendment believed that precedent had been established <br />with other signage changes and this building/project is one of the last in the development. <br />The Commission members that voted against the amendment believed it is the responsibility of the <br />Planning Commission to adhere to the rules where clearly defined. <br />The Planning Commission voted 4-2 to recommend approval of the amendment to the PUD Agreement. <br />Public Comment <br />The applicant stated that the additional signage was not intended for off-site visibility. As the store is not <br />a destination, the signage is intended to catch people leaving Wal-Mart.
