Developer Agreement <br />Renner 4t'' Addition <br />Page 7 <br />8.) Park Dedication -Park dedication requirements shall be satisfied by paying a park dedication <br />fee in the amount of $28,605.60, ($2,320 per acre for 12.33 acres in the Subdivision) prior to release <br />of the final plat for recording. <br />9.) Development Plan - <br />Purposefully Left Blank <br />10.) Landscaping <br />Purposefully Left Blank <br />11.) Wetlands/ NPDES <br />(01) National Pollutant Discharge Elimination System Requirements -Prior to the <br />commencement of grading the Developer shall provide a signed Storm Water Pollution <br />Prevention Plan for City review and approval to control erosion from the site. Because the <br />site is over one (1) acre, the Developer shall also apply for and obtain an NPDES permit <br />from the Minnesota Pollution Control Agenry. <br />12.) Additional Conditions -Developer specifically agrees to the conditions attached as Exhibit A <br />to City Council Resolution No. 08 - 42, which conditions are hereby specifically incorporated into <br />this Agreement and made a part hereof. Developer also agrees to the following conditions: <br />(01) The development shall meet all applicable fire codes. The Fire Chief shall verify <br />the location of all fire hydrants, and may require additional hydrants necessary to preserve <br />the health and safety. <br />(02) Surface Water Management Fee -Developer shall pay surface water management <br />fees in the amount of Thirteen Thousand, three Hundred Sixteen and 40/100 dollars <br />($13,316.40), ($1,080 per acre) for each lot in the Subdivision prior to release of the final plat <br />for recording. <br />(03) Seal coating -Developer shall pay the City for the first seal coating of streets in the <br />Subdivision in the amount of Seven Thousand Five Hundred and 00/100 Dollars ($7,500) <br />prior to recording of the final plat. <br />(04) Engineer Comments. The Public Works Director's comments, dated May 20, 2008 <br />be incorporated into the plans, attached as Exhibit G. <br />(05) Environmental Comments. All comments contained in Environmental <br />Technicians memo dated May, 19, 2008 shall be addressed, attached as Exhibit H. <br />(06) An association shall be established for the shared well system, identifying and sharing <br />maintenance and use costs. <br />(07) Approved Street Signage plan shall be submitted prior to Final Plat application. <br />C:\Documents and Settings\jmiller\Local Settings\Temporary Internet Files\OLK3E\DEVELOPER AGREEMENT.doc <br />
